Terms of service

These terms cover work carried out by Fun Life Media ("we", "us") for a client ("you"), and any goods bought through funlifemedia.co. By commissioning work or placing an order you accept them.

1. Quotes and scope

Every project is quoted in writing before it starts. A quote covers the scope described in it and nothing else. Work outside that scope is quoted separately and only begins once you approve it in writing.

2. Deposits and payment

Build projects require a 50% deposit before work begins, with the balance due on completion and before a site is published to your live domain. Monthly care plans and growth retainers are billed in advance. Invoices are payable within seven days unless the quote says otherwise.

3. Care plans and retainers

Monthly plans run month to month and can be cancelled at any time with notice before the next billing date. We do not lock you into a fixed term. Cancelling ends future billing; it does not refund a month already started.

4. Your responsibilities

You are responsible for supplying content, product information, access to your accounts, and timely feedback. Projects are quoted on the assumption that these arrive without long delays. Extended delays may require the timeline and price to be requoted.

5. Ownership

Once a project is paid in full, you own the custom code, page layouts and content we produced specifically for you, and you may modify them freely. We keep ownership of our own underlying tools, libraries and any booking software licensed to you, which you may use for as long as your plan is active. Photography and video are licensed to you for the uses agreed in the quote; we retain copyright and the right to show the work in our portfolio unless you ask us in writing not to.

6. Third-party services

Your store depends on services we do not control, including Shopify, payment providers, apps and hosting. We are not responsible for their outages, pricing changes or policy changes, though we will help you work around them.

7. What we do not guarantee

We do not guarantee particular sales figures, search rankings, advertising returns or booking volumes. Anyone who does is guessing. We guarantee the work described in the quote, delivered competently.

8. Liability

Our total liability for any claim relating to a project is limited to the amount you paid us for that project. We are not liable for indirect or consequential loss, including lost profit or lost data, except where the law does not allow that limit.

9. Governing law

These terms are governed by the laws of the Republic of South Africa, and nothing in them limits your rights under the Consumer Protection Act 68 of 2008 or the Electronic Communications and Transactions Act 25 of 2002.

10. Changes

We may update these terms. The version published here at the time you commission work is the version that applies to it.
